ScaleLife Wallet Terms of Service.

The following are the terms and conditions applicable to the ScaleLife Wallet service.

These ScaleLife Wallet Terms of Service (the “Wallet Terms”) govern your use of ScaleLife Wallet, a payment service (the “Service”) offered by 124ScaleLife.com (“ScaleLife,” “we,” “our,” or “us”). By using the Service, you agree to be bound by these Wallet Terms, the E-Sign Consent, and the General Terms of Service (“General Terms”) and all other terms, policies, and guidelines applicable to the Services, including, but not limited to, the Return Policy and Privacy Policy. If you are using the Service on behalf of a business or entity, that business or entity accepts these terms.

1. ScaleLife Wallet Balance; Redemption.

ScaleLife Wallet accounts are issued, free of charge, by 124ScaleLife.com to all of its registered members. This includes already registered members pre-dating the service. Upon a new user registration, your ScaleLife Wallet will automatically redeem a $5 credit for you (promotion expires on 12/31/2018). When you add funds to your ScaleLife Wallet balance (“reload” your balance), or receive an “allowance” (a credit from ScaleLife for leaving a product review, returning an item, or logging in daily) these funds will be available immediately for your next purchase.

When used, purchases are deducted from your ScaleLife Wallet balance. Any unused ScaleLife Wallet balance will remain associated with your ScaleLife User Account. If a purchase exceeds your ScaleLife Wallet balance, the remaining amount must be paid with another payment method.

Your ScaleLife Wallet balance may only be redeemed toward the purchase of eligible goods and services provided by ScaleLife on 124ScaleLife.com. Eligible goods and services are subject to change in our sole discretion.

2. Limitations.

Your ScaleLife Wallet balance cannot be used to purchase a ‘Wallet topup’ and add funds to your wallet. ScaleLife Wallets cannot be reloaded; resold; used for payment outside of 124ScaleLife.com; used for unauthorized advertising, marketing, sweepstakes or other promotional purposes; redeemed for more than face value; transferred for value; redeemed for cash; or returned for a cash refund (except to the extent required by law). Your ScaleLife Wallet balance will not be applied to the purchase of goods or services at any ScaleLife-affiliated property outside of the United States.

3. Peer to Peer Service

1. Description Of Service

The peer-to-peer Service (“P2P”) allows you to transmit funds or receive funds for P2P personal, non-commercial purposes.

2. Sending Cash

Once you have registered for 124ScaleLife.com and have an Eligible ScaleLife User Account you will be able to initiate funds transfers. As a party initiating a transfer (“Sender”), you will transfer funds to your selected recipient (“Recipient”) by designating the Recipient and the transfer amount to us (collectively “Payment Instructions”). Your Payment Instructions authorize us (1) to move funds from your Eligible ScaleLife User Account’s Wallet Balance and to your designated Recipient (a “Payment”). By submitting a Payment Instruction, you are also authorizing us to move money to your ScaleLife Wallet Balance for Payments that are canceled or otherwise returned (a “Credit”).

You understand and agree that when you initiate a Payment Instruction from an Eligible ScaleLife User Account using the Service, the processing of the Payment Instruction will begin, and funds will leave your Eligible ScaleLife User Account Balance, as early as the day of the initiation of such Payment Instruction. However, we will only begin to process the requested transfer of funds to the Recipient once the Recipient has provided all required information, and you hereby authorize and direct us to retain such funds until the earlier of such time as the Recipient has provided all required information or fifteen (15) days.

You agree that we shall incur no liability if we are unable to complete any transaction because of: (i) insufficient funds in the Eligible ScaleLife User Account Balance; (ii) malfunction of the Service due to circumstances beyond our control or due to circumstances that you were already aware of at the time you initiated your Payment Instruction; (iii) inaccurate or insufficient Payment Instructions; or (iv) failure of the Recipient to claim the Payment.

3. Requesting Cash

This cannot be done via our service just yet. For now, you can simply contact the appropriate ScaleLife User that you would like to request funds from and send them a private message asking them to send you money for ScaleLife via their ScaleLife Wallet balance.

4. Receiving Cash

Once you have created an Account, you can start to receive cash immediately:

  1. Your ScaleLife Wallet will hold all Cash Back funds from your shopping and keep them attached to your account. Your ScaleLife Wallet will also hold in-bound payments and fund transfers from other ScaleLife users. To transfer such funds you will have the option to:
  2. keep the funds in your ScaleLife Wallet balance for future P2P or Cash for Business transactions.

You understand and agree that there may be a delay between the time you are notified of a pending Payment Instruction and the deposit of the Payment into your Eligible ScaleLife Wallet Balance, and that you may be required to take additional steps to facilitate the deposit. You authorize us to send you emails or text messages related to any Payment directed to you.

5. P2P Payment Amounts

Additional identification information may be required to send more than five thousand dollars ($5000) in any one transaction or in multiple transactions over any rolling seven (7) day period or to receive more than one hundred thousand dollars ($100,000) in any trailing thirty (30) day period. Senders may not send more than two hundred fifty thousand dollars ($250,000) in any one transaction or in multiple transactions over any rolling seven (7) day period. We may adjust these limits at any time in our reasonable discretion. Current limits are posted on our Support Center.

6. P2P Fees

There are currently no fees for sending money using an Eligible ScaleLife Wallet balance, or funds held in the ScaleLife Wallet through P2P. We reserve the right to charge for and/or change the fees associated with use of the Service at any time subject to these Wallet Terms.

7. P2P Payment Cancellation, Stop Payment Requests and Refused Payments

Sender may not cancel or stop a Payment Instruction once it is sent and the processing of the Payment Instruction to the Recipient’s Eligible ScaleLife Wallet balance has begun. Our ability to stop a Payment Instruction or recover funds associated with an unauthorized Payment Instruction will depend on how the Payment Instruction was initiated, and whether the Payment Instruction has begun processing. Payments not automatically claimed by a Recipient for fifteen (15) days after the processing has begun will be canceled automatically. We will attempt to return any unclaimed, refused, refunded, prohibited, or denied Payment to your Eligible ScaleLife Wallet balance. If we are not able to do so, we may use other reasonable means to return the Payment to you, as permitted by applicable law.

8. Liability For Unauthorized P2P Transfers
  1. Unauthorized Fund Transfers. We treat unauthorized P2P transfers seriously and will provide you with all the support we can to help you resolve an unauthorized P2P transfer. You should, however, follow the terms of your Card agreement and contact the issuer of the Card immediately upon becoming aware of any unauthorized transfers because if a Sender later disputes the payment, the Card issuing bank will determine whether the dispute is valid and to whom payment is due. You agree to allow 124ScaleLife.com to recover any amounts due to cover your liability. However, fraudulent transactions may result in the loss of your money with no recourse.
  2. Unauthorized Transfers from your ScaleLife Wallet balance. You agree to notify us immediately upon becoming aware of any error or omission by us related to funds held in your ScaleLife Wallet. When you contact us, you must provide: (i) your name; (ii) a description of the suspected error or omission, an explanation of why you believe it is an error or why you need more information; and (iii) the dollar amount of the suspected error. If you provide this information orally, we may require that you also send written notification within ten (10) business days.

We will generally tell you the results of our investigation into the suspected error within ten (10) business days of receipt of your written notification (or your oral notification, if no written notification is requested). However, if necessary, we may take up to forty-five (45) days to complete our investigation. If we do so, we will provisionally credit funds to your ScaleLife Wallet within ten (10) business days for the amount of the suspected error. If we ask you to submit your complaint or question in writing and we do not receive it within ten (10) business days, we may not provisionally credit funds to your ScaleLife Wallet. We will correct any confirmed error promptly. If we determine there was no error, we will mail you a written explanation within three (3) business days of completing our investigation, and we may revoke any provisional credit provided to you. You may ask for copies of documents used in our investigation.

4. Risk of Loss.

The risk of loss and title for ScaleLife Wallet balances pass to the purchaser upon our electronic transmission of the ‘Wallet topup’ funds to the purchaser or designated recipient, or our delivery to the carrier, whichever is applicable. ScaleLife Wallet topups must be obtained from 124ScaleLife.com directly. There is no authorized third party, and you are responsible for safeguarding your 124ScaleLife.com User Account and ScaleLife Wallet balance from unauthorized use. We are not responsible if any ScaleLife User Account credentials have been lost, stolen, or destroyed, or if your ScaleLife User Account and ScaleLife Wallet balance is used without your permission. There are a variety of phishing scams that request payment by electronic means, personal identifiable information, and online account login credentials. Your ScaleLife User Account and ScaleLife Wallet balance will not be immune to this.  Please safe guard your account information! ScaleLife is not responsible for, and assumes no liability to you for, any unlawful conduct or fraud by any third party associated with any ScaleLife Wallet balance.

5. Use of ScaleLife Wallet in Violation of these Terms and Conditions.

By using the ScaleLife Wallet service you agree to comply with these terms and conditions, and not to use your ScaleLife Wallet Balance in any manner that is misleading, deceptive, unfair, or otherwise harmful to 124ScaleLife.com, or its customers. We reserve the right, without notice to you, to void ScaleLife Wallet balances without a refund, suspend or terminate customer accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment if we suspect that electronic funds have been debited to your account and are obtained, used, or applied to a 124ScaleLife.com User Account (or your 124ScaleLife.com Wallet Balance is applied to a purchase) fraudulently, unlawfully, or otherwise in violation of these terms and conditions.

6. Limitation of Liability.

TO THE FULL EXTENT PERMISSIBLE BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO YOUR 124SCALELIFE.COM WALLET BALANCE, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULL EXTENT PERMISSIBLE BY LAW, IN THE EVENT A SCALELIFE WALLET IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE CREATION OF A NEW USER ACCOUNT.
